Terms of Service

Welcome to Bottles By Bird. These Terms of Service ("Terms") govern your access to and use of our website and the purchase of products through it (the "Services"), operated by bottles by bird, CVR: 38657968, Gammel Kongevej 102, 1850, Denmark ("we", "us", "our"). bottles by bird is powered by Shopify.

By accessing our website, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who Can Order

Our products include alcoholic beverages. By placing an order, you confirm that:

You are at least 18 years old, the legal minimum age for purchasing alcohol in Denmark.
The information you provide is accurate, current, and complete.
You are purchasing for personal, non-commercial use, unless otherwise agreed with us in writing.

We reserve the right to request proof of age at the point of delivery and to refuse delivery, cancel, or refund an order where age cannot be verified. Our courier partners may also independently require ID checks upon delivery in accordance with Danish alcohol sales regulations.

2. Products and Pricing

All prices are displayed in DKK and include Danish VAT (moms) unless stated otherwise.
We make reasonable efforts to ensure product descriptions, images, and prices are accurate, but errors may occasionally occur. If we discover a pricing or description error after you've placed an order, we will contact you before processing the order and give you the option to confirm at the correct price or cancel with a full refund.
Product availability is not guaranteed until your order is confirmed. If an item becomes unavailable after you order, we will notify you and offer a substitute, refund, or partial refund for that item.
We reserve the right to limit quantities per order or per customer.

3. Orders and Payment

Placing an order constitutes an offer to purchase, which we accept when we send you an order confirmation email.
Payment is processed securely through Shopify's payment infrastructure at the time of order. We do not store your full card details.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or where age cannot be verified. If we cancel an order after payment, you will receive a full refund.

4. Delivery

We deliver within the areas specified at checkout. Estimated delivery times are provided in good faith but are not guaranteed.
Someone able to present valid ID showing they are 18 years or older must be present to receive alcohol deliveries. If no eligible recipient is available, the courier may be unable to leave the delivery, and redelivery or collection fees may apply.
Risk of loss and title to products pass to you upon delivery.
Delivery costs, if any, are shown at checkout before you complete your purchase.

5. Right of Withdrawal and Returns

Please see our separate Return Policy for full details. In summary: under § 18(2) of the Danish Consumer Contracts Act, the standard 14-day right of withdrawal does not apply to food, drinks, and similar perishable goods intended for everyday household consumption, including alcoholic beverages. This means we do not accept returns for change of mind once an order has been dispatched. Your statutory rights under the Danish Sale of Goods Act (Købeloven) in relation to faulty or damaged goods, including the 2-year right of complaint (reklamationsret), remain unaffected — see our Return Policy for how to make a complaint.

6. Responsible Consumption

We encourage responsible and moderate alcohol consumption. Products sold through the Services are intended solely for consumers who are legally permitted to purchase and consume alcohol. We do not knowingly sell to individuals under the age of 18 or to intoxicated individuals presenting at the point of delivery.

7. Account Registration

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at tricks@birdcph.dk if you suspect unauthorized use of your account.

8. Intellectual Property

All content on the Services — including text, graphics, logos, images, and the bottles by bird name and branding — is owned by or licensed to us and protected under Danish and international copyright and trademark law. You may not reproduce, distribute, or otherwise use this content without our prior written consent, except for personal, non-commercial use in connection with your order.

9. User Conduct

When using the Services, you agree not to:

Provide false information, including about your age.
Use the Services for any unlawful purpose or in violation of these Terms.
Attempt to interfere with the security or proper functioning of the website.
Resell products purchased through the Services without our prior written consent.

10. Limitation of Liability

To the extent permitted under Danish law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Services or purchase of our products. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Danish law, including liability for death, personal injury caused by our negligence, or liability under the Danish Product Liability Act (Produktansvarsloven).

11. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal or regulatory reasons. We will post the revised Terms on this website and update the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. For orders already placed, the Terms in effect at the time of your order will apply.

13. Governing Law and Disputes

These Terms are governed by Danish law. Any dispute arising from these Terms or your use of the Services will be subject to the jurisdiction of the Danish courts, without prejudice to any mandatory consumer protections applicable in your country of residence if you are an EU/EEA consumer.

14. Severability

If any provision of these Terms is found unenforceable under Danish law, the remaining provisions will continue in full force and effect.
